Child Support

"Live so that when your children think of fairness and integrity, They think of you."
-- H. Jackson Brown, Jr.

Kentucky law requires that children be supported by their parents. A formula was devised by the legislature that considers both parents gross income, maintenance payments recieved by a parent, child care expenses, medical expenses, and possibly other child support paid by a parent. Many people go to several websites online and try and use a basic formula sheet for calculating their support. However, more can go into the calculation than just the basic information. You may get an adjustment for equal parenting time or for being over the child support income chart. It is adviseable to seek legal counsel prior to agreeing to any child support amount. Kinberger Law Office will be happy to meet with you for a free 30 minute consultation to advise you about the Kentucky Child Support Guidelines.

In Kentucky if you fall behind in your child support more than $1,000, it is considered a felony. You may even be brought to a grand jury for your failure to pay your support. Make sure you always pay your support in a timely manner to the Child Support Division. Too many times a parent claims that paid the other parent with cash and then gets brought into Court because the Child Support Division has no record of that parent's payments. Also never pay your child support with cash. Always make sure you have a receipt for your payments. Your freedom could depend on it.

Also under Kentucky law a parent who is to recieve child support is entitled to 12% annual interest on past due child support payments. If Child Support Division takes your case to court, they do not always go after the interest that is due you. Kinberger Law Office always creates a professional spreadsheet that can be used by the Court to quickly see ALL amounts that are owing to the parent that is to recieve child support.

Many people believe that when one child becomes emancipated then you simply just cut the child support in half and begin simply paying the lesser amount. Many then get hit with child support arrearages because they did not get their child support amount adjusted by the Court. ALL changes in child support must be approved by the Court reflected by a Court Order signed by the Judge. Kinberger Law Office will be happy to assist you in getting your child support reduced to reflect an accurate amount of child support due under the Kentucky Child Support Guidelines.
